This week we will consider criminal law issues and their role in sports. The readings are attached. In sports, criminal issues often consist of PR problems for the league or team or organization (and player too). Properly addressing these issues requires and depends upon an understanding of the criminal process. Attached readings include an overview of the criminal process and two articles addressing how criminal issues intersect with sports organizations.
For your assignment please prepare an IRAC analysis of the attached case. Also attached is a document summarizing how to perform an IRAC analysis. IRAC stands for Issue, Rule, Analysis and Conclusion. An IRAC analysis has many similarities to a case brief, which you know how to do. The IRAC analysis focuses more on the legal rule and its implications. In particular, please be sure to consider how the rule of the case may be applied to future situations.
For your IRAC analysis this week, due Monday, April 11, by email, I attach a case dealing with electronic data stored on a computer hard drive. As you will see when you read the case, the court must struggle with applying the principle of the Fourth Amendment to a new situation involving electronic data. Please consider in your IRAC analysis how the court’s holding may be applied in future situations as data storage changes and evolves. Of course we now have cloud storage which can further complicate these issues. Please remember to name your word document with your name and the assignment and also place that same information in the subject line.
